Limits on Internships
- A skilled worker cannot be replaced on a farm by an intern.
- Farm owners must show that the intern’s responsibilities will enhance existing employees rather than replace them or have a detrimental impact on them.
- Due to a labor cost advantage, hiring an intern cannot result in unfair rivalry with other farms.
- A farm can only host three interns at once.
It’s critical to realize that volunteers cannot serve as interns for a private, for-profit company. Under the Fair Labor Standards Act, farm internships may be excluded from minimum wage and overtime restrictions if they satisfy certain standards.
