Eligibility Criteria

To be eligible to qualify for the program, a farm must be located in one of the following counties and have annual sales of less than $250,000.

Limits on Internships

• A skilled worker cannot be replaced on a farm by an intern.
• Farm owners must show that the intern’s responsibilities will enhance existing employees rather than replace them or have a detrimental impact on them.
• Due to a labor cost advantage, hiring an intern cannot result in unfair rivalry with other farms.
• A farm can only host three interns at once.

It’s critical to realize that volunteers cannot serve as interns for a private, for-profit company. Under the Fair Labor Standards Act, farm internships may be excluded from minimum wage and overtime restrictions if they satisfy certain standards.
